- The AI drafts. You, the licensed inspector, review, correct and confirm every finding, arrow, description and section before it reaches a client.
- AI output can be wrong. BlueTape AI is not liable for errors in AI output or in any report you deliver, including any claim, lawsuit or licensing action that follows.
- Your data is collected and used solely to create and store your inspection reports. It is not sold, and it is not shared except with the providers needed to run the Service.
This summary is for convenience. The full Agreement below is what applies.
1. Who this Agreement is between
This User Agreement (the "Agreement") is a binding contract between you and the operator of BlueTape AI ("BlueTape AI", "we", "us"). It governs your use of the BlueTape AI application, website and related services (the "Service").
By creating an account, checking the acceptance box, or using the Service, you agree to this Agreement. If you accept on behalf of a company, you confirm that you have authority to bind that company, and "you" includes the company.
If you do not agree to this Agreement, do not use the Service.
2. What the Service is, and what it is not
BlueTape AI is a drafting and organizing tool for licensed home inspectors. It uses artificial intelligence ("AI") to sort photographs, suggest which defect appears in a photograph, place a marker on it, propose descriptive text, and assemble that material into a report format.
The Service is not a home inspector. It does not perform inspections and does not provide engineering, legal, construction or other professional advice. It does not replace your on-site observation, your training, your standards of practice or your professional judgment.
No output of the Service is an inspection finding until you have reviewed it and confirmed it.
3. AI makes mistakes. You are responsible for reviewing everything.
AI-generated output can be wrong. It can miss a defect that is present, flag a defect that is not there, point the marker at the wrong place, describe a condition inaccurately, file a photograph under the wrong section, or produce text that is incomplete, outdated or inconsistent with the standards that apply to you. The AI knows nothing about the property beyond what appears in the photographs and the text you enter.
You agree that:
- You will personally review every photograph, marker, description, classification, status and section of text the Service produces before it is delivered to a client or to any other person.
- You will correct or remove anything that is inaccurate, and add anything the Service missed.
- You, not BlueTape AI, decide what your report says. Every report you deliver is your professional work product, issued under your license and in your name, and you are its sole author of record.
- You will not deliver, publish or rely on AI-generated content that you have not reviewed.
- You will comply with every law, regulation and standard of practice that applies to your inspection work, including the licensing requirements of the state where you inspect (in Florida, Chapter 468, Part XV, Florida Statutes, and the rules adopted under it).
The Service marks nothing as final. The presence of AI-generated text in a report does not mean the Service has verified it.
4. No warranties
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, completeness, non-infringement, and uninterrupted or error-free operation.
We do not warrant that AI output will be accurate, complete, current or compliant with any standard, code or law, or that it will identify every defect, or any particular defect, in a property.
5. Limitation of liability
To the fullest extent permitted by law, BlueTape AI and its owners, officers, employees, contractors and suppliers will not be liable to you or to anyone else for any claim, loss, damage, cost or expense arising out of or related to: (a) any error, omission or inaccuracy in AI-generated output; (b) any inspection report, finding or statement that you prepare, deliver or fail to deliver using the Service; (c) any defect in a property that the Service did not identify; (d) any dispute, demand, lawsuit, arbitration, claim, judgment, settlement, fine, penalty, regulatory or licensing action, or civil or criminal proceeding brought against you by a client, a buyer or seller, a real-estate professional, an insurer, a licensing board, a government agency or any other person in connection with your inspection work; or (e) your reliance on, or use of, the Service.
We will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business or loss of data, however caused and under any theory of liability, even if we were advised of the possibility of such damages.
If, despite the above, we are found liable to you for any reason, our total liability for all claims together will not exceed the greater of (i) the amount you paid us for the Service in the twelve months before the event giving rise to the claim, or (ii) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain warranty disclaimers or liability limits. In those places our liability is limited to the smallest amount the law allows. Nothing in this Agreement limits liability that cannot be limited by law.
6. Indemnification
You will defend, indemnify and hold harmless BlueTape AI and its owners, officers, employees, contractors and suppliers from and against any claim, demand, lawsuit, proceeding, loss, liability, damage, cost and expense (including reasonable attorneys' fees) arising out of or related to: (a) any inspection report or other work product you create, deliver or fail to deliver; (b) your review of, or failure to review, AI-generated output; (c) your breach of this Agreement; (d) your violation of any law, regulation, standard of practice or third-party right; or (e) the photographs, information and content you submit to the Service.
7. Your data is collected only to create and store your reports
We collect and store only what is needed to create, store and deliver your inspection reports and to operate your account: your login details; your name, license number and phone number for display on reports; the company you belong to; the photographs you upload or capture; property addresses, client names, inspection dates and report text; and security records such as sign-in times and device information.
We use this data solely to provide the Service to you: to generate findings and descriptions, to assemble reports, to keep your account secure, and to give your company's administrator the tools to manage its accounts. When an inspector corrects an AI draft, the correction (the item, the wording and a short text description of what the photo showed, but not the photo itself) is kept in your company's own reference library so that later drafts follow it. Learned entries stay within your company and are never used for another company. We do not use your data for advertising or marketing, and we do not build profiles of you, your clients or the properties you inspect.
We do not sell your data. We do not rent, trade or share it with third parties, with only these narrow exceptions:
- Service providers that process it on our behalf and under our instructions in order to run the Service. Photographs and text are sent to our AI model provider (Anthropic) only to produce the findings, classifications and descriptions returned to you. Under the commercial terms we use, the provider may not use your data to train its models or for any purpose other than returning results to the Service.
- Your company's administrator, who can see the accounts, security activity log and report template of the company they manage.
- When required by law, subpoena, court order or other valid legal process, or when necessary to protect the rights, safety or property of BlueTape AI, our users or the public. Where the law allows, we will tell you before we disclose.
- A successor operator, if the Service is transferred to another entity, who must honor this Agreement for the data it receives.
You work on an inspection in your browser, and its photographs and text are stored on the device you are using. A copy is also kept on our servers so that a lost, replaced or cleared device does not destroy your work, and so that you can pick a job up on another device. That copy belongs to your account, is not shown to other inspectors at your company, and is deleted when you delete the inspection. Account records are stored on our servers with personal fields encrypted at rest.
8. Fees, billing and cancellation
Photographing an inspection, the AI drafts and your edits are free to use. Opening a finished report requires a paid plan, chosen by an administrator of your company. The plans, their prices and what each includes are shown in the app before you choose one, and those figures are what apply.
Plans are priced in one of two ways, and the app says which before you choose. A pay-per-report plan has no monthly fee and charges a fixed amount for each report you open, billed at the end of the month in which you open it. A monthly plan is billed in advance and includes a set number of reports each calendar month, or an unlimited number where the plan says so.
Opening a report for the first time is what counts and what is charged. Reopening, editing, printing or exporting that same report never counts or charges again. On a plan with a monthly number included, unused reports do not carry over, and once they are used no further reports can be opened until the plan renews or is changed. Plans renew automatically until cancelled.
- Cancel at any time. Cancellation stops the next renewal; it does not refund the current month, and reports already opened stay available to you.
- If a payment fails, access to open new reports stops until it is resolved. Reports already opened are not taken away.
- Prices may change. We will tell you before a change takes effect, and it will not apply to a month already paid for.
- Except where the law requires otherwise, payments are non-refundable.
- Payment card details are handled by our payment processor, not by us. We never see or store your card number.
- You are responsible for any taxes that apply to your purchase.
Your inspections, photographs and data remain yours whether or not you have a subscription, and are not deleted because a plan lapsed.
9. Your content, ownership and deletion
You own the photographs, reports and other content you submit or create. You grant us a limited, non-exclusive license to store, process, transmit and display that content only as needed to provide the Service to you. You are responsible for having the right to submit it, including any permission needed to photograph the interior of a property.
You can delete inspections and their photographs at any time from within the Service. Deleting an inspection removes it from your device and deletes our backup copy of it, photographs included. "Sign out and erase data on this device" clears that device only and leaves the backup in place, so the work can be restored elsewhere. Company administrators can remove accounts. When your account is removed, its record is deleted; security and acceptance records may be kept for a limited period as needed to keep the Service secure and to comply with law.
10. Accounts and security
Keep your password secret and do not share your login. You are responsible for all activity under your account. Tell your company's administrator immediately if you believe your account has been compromised. Use a device passcode, and use "Sign out and erase data" on any shared device.
Your name and license number are recorded when your account is created, confirmed by you at that moment, and are permanent. They appear on every report produced from your account and cannot be changed in the app afterwards. Each inspector must have their own login: accounts, and the subscriptions attached to them, are not to be shared, and a report must carry the name and license of the inspector who actually performed it.
11. Acceptable use
You will not: use the Service for anything other than home-inspection work; upload content you do not have the right to use; attempt to access another company's data or another person's account; probe, scan or test the Service for vulnerabilities without our written permission; interfere with its operation; or reverse-engineer, copy or resell it.
12. Suspension and termination
We may suspend or end your access if you breach this Agreement, if you do not pay, if the law requires it, or if continuing would create risk to the Service or to other users. Your company's administrator may remove your account at any time. Sections 3 through 9, 14 and 15 survive termination.
13. Changes to this Agreement
We may update this Agreement. When we do, the version and effective date at the top change, and you will be asked to review and accept the new version before continuing to use the Service. Each acceptance is recorded with the date, time and version accepted.
14. Governing law and general terms
This Agreement is governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising from this Agreement or the Service will be brought exclusively in the state or federal courts located in Florida, and you consent to their jurisdiction.
If any part of this Agreement is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it. This Agreement is the entire agreement between you and BlueTape AI about the Service and replaces any earlier understanding.
